PARTICIPANT WAIVER & RELEASE OF LIABILITY

READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS

By reserving, purchasing, or participating in any tour or activity offered by Marquee Tours (“SERVICER”), I (“PARTICIPANT”) agree to the following:

1. Assumption of Risk.
   I understand that tours involve inherent risks, including physical activity, uneven terrain, weather conditions, and travel-related hazards. I voluntarily assume all risks associated with participation, including the risk of injury, death, or property loss.

2. Release of Liability.
   To the fullest extent permitted by Oregon law, I release and waive all claims against SERVICER arising out of my participation in the tours, including claims resulting from SERVICER’s negligence.

3. Personal Responsibility.
   I agree to follow all instructions and rules and accept responsibility for my conduct, health, and well-being during the tour. I agree to pay for any damage caused by my actions.

4. Medical Authorization.
   If medical care is required, I authorize SERVICER to arrange emergency treatment at my expense.

5. Indemnification.
   I agree to indemnify and hold SERVICER harmless from claims arising from my participation.

6. Minors.
   If I am participating with a minor, I represent that I am the parent or legal guardian and agree to this waiver on the minor’s behalf.

7. Governing Law & Disputes.
   This Agreement is governed by Oregon law. The parties agree to attempt to resolve disputes through good-faith negotiation and mediation before pursuing other legal remedies.
